1. Agreement to Terms

By visiting, browsing, accessing, or placing an order on www.handmadeoilart.com, you ("Customer", "User", "you") agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, Refund & Cancellation Policy, and any other policies referenced herein. If you do not agree to all of these Terms, you must immediately discontinue using our Site.

 

2. Made-to-Order & 100% Hand-Painted Nature of Products

A. Authentic Handcrafted Artwork

All paintings offered on Handmade Oil Art are 100% hand-painted by professional master artists using heavy oil and acrylic pigments on natural linen canvas. We do not sell flat machine prints, giclées, canvas transfers, or digital poster reproductions.

B. Natural Artistic Variations

Because each piece is individually crafted and painted by hand upon order, slight variations in brushstroke texture, impasto layering, pigment blend, and minor tonal subtleties are natural characteristics of authentic fine art. While our artists follow the design compositions closely, no two original oil paintings are identical. Such artistic uniqueness is celebrated and does not constitute a defect or deviation from the product description.

 

3. Orders, Production Timeline, and Curing

A. Production & Drying Period

Oil painting is a tactile physical medium requiring adequate drying and curing time:

Painting Time:

  • 7 to 14 business days depending on size, complexity, and impasto thickness.

Curing & Drying Time:

  • 7 to 14 business days before packaging to ensure oil layers are sufficiently dry and protected from smudging or sticking.

Framing & Crating:

  • 2 to 4 business days for custom floating frame assembly and wooden crate packaging.

Standard Estimated Total Lead Time:

  • Approximately 3 to 5 weeks from order placement to final delivery.

B. Order Confirmation & Photo Approval

Upon completion of the painting, we provide high-resolution studio photographs of your finished piece for review prior to dispatch. If minor adjustments are requested, our artists will touch up the piece before framing and shipping.

 

4. Pricing, Taxes, and Payment

Currency:

  • All prices listed on the Site are in United States Dollars (USD) unless otherwise selected at checkout.

Price Changes:

  • We reserve the right to modify prices, shipping estimates, and promotional discounts at any time without prior notice. Active orders already paid and confirmed will not be affected.

Taxes & Customs Duties:

  • Applicable sales tax will be collected at checkout in accordance with US state tax laws. For international orders, shipments are handled via reputable international carriers (FedEx / DHL). Customers are responsible for any destination-country VAT, import duties, or customs tariffs assessed by their local customs authorities.

 

5. Shipping, Packaging, and Delivery

A. Packaging Standards

To protect high-value framed artwork during international transit:

Rolled Canvas:

  • Shipped inside heavy-duty, moisture-sealed PVC or reinforced mailing tubes.

Stretched & Framed Art:

  • Packaged with acid-free protective paper, corner protectors, multi-layer high-density foam, heavy-duty corrugated cartons, and reinforced wooden skeleton crates or plywood packaging for oversized items.

B. Carrier & Tracking

Shipments are fulfilled via FedEx International Priority / Economy or DHL Express. Tracking numbers will be provided upon dispatch.

C. Inspection Upon Delivery & Damaged Shipments

Please inspect your shipment immediately upon arrival:

  • If the outer wooden crate or box shows visible signs of severe transit damage, document it with clear photos before unpacking.
  • In the rare event that the artwork is damaged during transit, you must notify us at

48 hours of delivery

with photographic evidence of the packaging and damage. We will immediately arrange a priority re-paint and replacement at no additional cost to you.

 

6. Cancellations, Returns, and Refunds

A. Cancellations

Within 24 Hours:

  • You may cancel your order for a 100% full refund within 24 hours of purchase.

After Production Begins (Day 2+):

  • Because materials (custom cut stretcher bars, linen canvas, artist commission) are dedicated immediately, cancellations requested after production has started but before dispatch are subject to a

25% restocking/materials fee

B. Custom Commissions & Size Specifications

Artworks customized to non-standard dimensions or painted from personal customer photographs are custom bespoke goods and cannot be returned for buyer's remorse once approved and shipped.

C. Standard Catalog Returns

For standard catalog designs, if you are not satisfied with your piece after receiving it, contact us within 14 days of delivery. The artwork must be returned in its original condition and packaging. Return shipping costs and crating fees are the responsibility of the customer unless the return is due to transit damage or a verified product defect.

 

7. Intellectual Property Rights

All content published on www.handmadeoilart.com—including website design, lifestyle room mockups, branding, text, graphics, logos, color palettes, and product catalog metadata—is the exclusive intellectual property of Handmade Oil Art and is protected by United States and international copyright laws. Unauthorized reproduction, scraping, copying, or commercial exploitation is strictly prohibited.

 

8. Limitation of Liability

To the maximum extent permitted by applicable law, Handmade Oil Art and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site, delays in shipping due to carrier disruptions or customs clearance, or natural minor variations in handmade artwork. Our total liability for any claim arising out of your purchase shall not exceed the amount actually paid by you for the specific product in dispute.

 

9. Governing Law and Dispute Resolution

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved through binding arbitration or within the state or federal courts located in Delaware.
